Tata Consultancy Services Faces Systemic Failure in Implementing POSH Policy
Tata Consultancy Services (TCS) is facing severe criticism from industry experts over its delay in responding to sexual harassment and religious conversion complaints at its Nashik facility. The company has been accused of failing to implement the Prevention of Sexual Harassment (POSH) policy effectively, leading to a systemic failure in addressing employee grievances.
The situation came to light when a woman working at TCS filed a complaint alleging that a colleague had maintained a physical relationship with her by promising marriage. The complaint led to the registration of eight more FIRs (first information reports) related to sexual harassment and religious conversion cases. The accused individuals have been identified as Asif Ansari, Shafi Sheikh, Shah Rukh Qureshi, Raza Memon, Tausif Attar, Danish Sheikh, and Ashwini Chainani.
A thorough investigation is underway to establish the facts and identify all individuals responsible for the situation. TCS has appointed Aarthi Subramanian, chief operating officer (COO), to lead the investigation. However, industry experts are questioning the company's response time and the effectiveness of its policies in addressing employee grievances.
TV Mohandas Pai, former chief financial officer and HR head of Infosys and chairman of Aarin Capital Partners, has expressed concerns over the company's failure to address the situation promptly. "There appears to be pandering to religious fanatics. There is open, aggressive behaviour from such groups. This has happened in other companies too," he said.
Pai has also suggested that better communication channels are needed for employees to directly connect with managers two levels above them. Employees should have regular "skip meetings" with a manager two levels above, without their immediate manager present. "This doesn't seem to be happening, because the issue has persisted for a long time," he said.

The case is currently under investigation by a special investigation team (SIT) led by assistant commissioner of police (Crime) Sandeep Mitke. With over 584,519 staff globally, TCS is one of the largest private sector employers in India, with well-structured employee policies in place being a Tata Group company.
Aditya Mishra, MD & CEO, CIEL HR, a recruitment and staffing firm, has expressed concerns over the company's failure to implement the POSH policy effectively. "In this particular case, it was all people with position of power and authority." Several accused who have been arrested are in team-leader positions.
Mishra has suggested that companies have whistleblower policies and three levels of escalations involved. Members from both genders need to be a part of the Internal Complaint Committee (ICC) and sexual harassment committees. Employees are supposed to be trained annually for them to understand what would amount to sexual harassment.
Pareekh Jain, CEO, EIIRTrend, has questioned the effectiveness of TCS' employee wellbeing policies in addressing the situation. "TCS is spreading to tier-II and tier-III cities towns, but employee wellbeing policies were clearly ineffective in this case. Policies need to be implemented in letter and spirit," he said.
In response to the allegations, Tata Sons Chairman N Chandrasekaran has called the incident "gravely concerning and anguishing". "This incident is being treated with the utmost seriousness. Action has already been initiated against the accused employees, and the company is extending its full cooperation to the ongoing investigations. The Tata Group maintains a zero-tolerance policy towards any form of coercion or misconduct by its employees," he said.
